I РОЗДІЛ

1. ВСТУП

1.1. Ці «Правила та Умови» та будь-які додатки, доповнення й інші невіддільні частини до них (далі по тексту – «Умови») є правилами організатора азартних ігор, що діє в суворій відповідності, в рамках та на підставі законодавства України про азартні ігри, а саме:

Конституції України,
Податкового кодексу України,
закону України «Про державне регулювання діяльності з організації та проведення азартних ігор» (далі по тексту – «Закон»),
закону України «Про запобігання та протидію легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдженню зброї масового знищення»,
нормативно-правових актів, що регулюють відносини у сфері азартних ігор, та відповідних міжнародних договорів України, згода на обов'язковість яких надана Верховною Радою України.

1.2. BETON ігровий онлайн-клуб, – під яким здійснює діяльність Товариство з обмеженою відповідальністю «СІТІКОД» (далі по тексту – «Клуб»), місцезнаходження: Україна, 04071, місто Київ, вул. Воздвиженська, будинок 45-47-49, офіс 208, ідентифікаційний код 45358454, та провадить діяльність з організації та проведення азартних ігор казино в мережі Інтернет на підставі відповідної ліцензії, виданої 20 листопада 2023 року на п’ять років Комісією з регулювання азартних ігор та лотерей на підставі Рішення № 364 від 03 листопада 2023 року.

1.3. Клуб здійснює діяльність в мережі Інтернет через вебсайт з доменним ім'ям beton.ua (надалі – вебсайт), який належить йому, відповідає вимогам Закону, і виключно через онлайн-систему, що також відповідає вимогам Закону.

1.4. Відвідуючи або використовуючи будь-який з розділів вебсайту, а також реєструючись на ньому з подальшим створенням акаунту, відкриттям рахунку та укладанням з Клубом договору щодо участі в азартних іграх після здійснення першої ставки на умовах, викладених в даних Умовах, ви:

1.4.1. Підтверджуєте, що вам вже виповнився 21 рік і не існує обмежень щодо вашої участі в азартних іграх;

1.4.2. Погоджуєтеся з даними Умовами, «Політикою конфіденційності», принципами «Відповідальної гри», «Правилами ігор» та іншими документами, розміщеними на вебсайті;

1.4.3. Підтверджуєте, що ви є власником банківського рахунку / рахунків (зокрема карткового / карткових), з якого / яких буде поповнюватися ігровий рахунок у Клубі та на який / які будуть перераховуватися виплати від Клубу, а також підтверджуєте, що маєте законне право розпоряджатись коштами на даному рахунку / рахунках;

1.4.4. Даєте згоду на обробку своїх персональних даних та надання їх, за потреби, відповідним фінансовим установам для здійснення виплат;

1.4.5. Даєте згоду на отримання рекламних матеріалів Клубу (бонуси, акції, інформація тощо), які розсилаються за допомогою поштових відправлень, email, sms, месенджерів, соціальних мереж та т.ін., а також погоджуєтесь з умовами рекламних акцій, що проводяться Клубом, бонусними та індивідуальними пропозиціями тощо.

1.5. Уважно ознайомтеся з Умовами та в разі категоричної незгоди з ними в цілому або з їх окремими положеннями утримайтеся від реєстрації на вебсайті. Подальше використання ресурсу розцінюється Клубом як згода з викладеними нижче Умовами.

2. ВИЗНАЧЕННЯ ТЕРМІНІВ

2.1. Акаунт – це особистий кабінет гравця, доступний тільки йому і уповноваженим співробітникам Клубу, в якому представлений профіль гравця з фінансовою інформацією, налаштування, повідомлення, верифікація, бонуси та інша інформація.

2.2. Азартна гра – будь-яка гра, умовою участі в якій є внесення гравцем ставки, що дає право на отримання виграшу (призу), ймовірність отримання і розмір якого повністю або частково залежать від випадковості, а також від знань і майстерності гравця. Не вважається азартною грою будь-яка гра, в якій відсутня принаймні одна з наступних ознак:

наявність ставки;
можливість отримання або неотримання виграшу (призу);
ймовірність виграшу (призу) і його розмір повністю або частково залежить від випадковості.

2.3. Азартні ігри казино, що проводяться в Інтернеті, – циліндричні ігри (рулетка), ігри в кості, ігри на гральних автоматах.

2.4. Верифікація (ідентифікація, встановлення даних) – підтвердження особи гравця, його віку та права на участь в азартних іграх.

2.5. Виграш (приз) – сума коштів, що підлягає виплаті (видачі) Гравцеві шляхом здійснення безготівкового переказу на його банківський рахунок в разі його виграшу в азартну гру відповідно до правил проведення такої азартної гри, розміщених на вебсайті, що перевищує загальний підсумок коштів, внесених Гравцем на Ігровий рахунок, зменшений на загальний підсумок всіх повернутих / виплачених такому гравцю сум.

2.6. Повернення коштів, внесених Гравцем для участі в азартних іграх – сума коштів, яка на вимогу Гравця повертається йому шляхом перерахування на банківський рахунок та не перевищує суму загального підсумку коштів, внесених гравцем на Ігровий рахунок, зменшеного на загальний підсумок всіх повернутих / виплачених такому гравцю сум.

2.7. Виплата – операція з переказу на вимогу гравця на банківський рахунок суми коштів, яку він вказав до виводу у власному Акаунті. В рамках однієї Виплати частина суми може бути Поверненням коштів, внесених Гравцем для участі в азартних іграх, а частина – Виграшем.

2.8. Генератор випадкових чисел – складова частина (в тому числі віддалена) ігрових автоматів і онлайн-системи Клубу. Під час проведення азартних ігор на вебсайті створює послідовність не пов'язаних між собою чисел і забезпечує випадковий характер виграшу (призу).

2.9. Джек-пот – максимальний виграш (приз), передбачений правилами проведення азартних ігор, величина якого встановлюється організатором азартних ігор або визначається ним залежно від загальної кількості внесених гравцями ставок.

2.10. Гра на ігровому автоматі, в рулетку – азартна гра, яка проводиться з використанням ігрового автомата, рулетки безпосередньо на сервері розробника ігор і в якій ймовірність виграшу (призу) і його величина визначаються генератором випадкових чисел.

2.11. Ігровий замінник гривні – матеріальний засіб гри в азартні ігри, електронний грошовий замінник, який дає можливість зробити ставку в азартній грі й представлений на балансі запущеної гри в сумі, яка кратна до тої, що знаходиться на ігровому рахунку гравця, з коефіцієнтом, рівним обраному номіналу. Ігровий замінник гривні придбавається в обмін на грошові кошти та, на вимогу гравця, підлягає обміну на відповідний грошовий еквівалент.

2.12. Ігровий рахунок (депозит) – клієнтський рахунок гравця, баланс – частина онлайн-системи Клубу, яка забезпечує гравця повною інформацією щодо його фінансових дій (поповнення, виплати, ставки, виграші), а також містить інформацію, необхідну для ідентифікації гравця.

2.13. Гравець – це фізична особа, яка:

на момент участі в азартній грі досягла 21-річного віку,
є дієздатною,
не перебуває в Реєстрі осіб, яким обмежений доступ до гральних закладів та / або участь в азартних іграх,
за власним бажанням зареєструвалася на вебсайті Клубу, пройшла верифікацію і бере участь в азартній грі.

2.14. Каса – розділ вебсайту, в якому здійснюються поповнення Ігрового рахунку (депозиту), продаж (видача) та обмін Ігрових замінників гривні, прийняття ставок від Гравців, замовлення Повернення коштів, внесених Гравцями для участі в азартних іграх, виплат Виграшів за результатами проведення азартної гри та інші дії.

2.15. Мобільний додаток – комп'ютерна програма (програмне забезпечення), призначена для роботи на мобільних пристроях, за допомогою якої через онлайн-систему здійснюється діяльність Клубу щодо організації та проведення азартних ігор.

2.16. Онлайн-система Клубу – сукупність технічних, програмних і програмно-апаратних засобів, яка забезпечує організацію та проведення азартних ігор, збір даних щодо прийнятих ставок, їх облік та реєстрацію, визначення, облік і виплату виграшів, а також здійснення інших операцій, пов'язаних з організацією і проведенням азартних ігор, зберігання відповідної інформації.

2.17. Відповідальна гра – базовий принцип організації й проведення азартних ігор, передбачає здійснення Клубом заходів щодо попередження й мінімізації негативних наслідків участі фізичної особи в азартній грі, а також заходів, спрямованих на організацію самообмежень і самоконтролю для гравців.

2.18. Відсоток повернення (RTP – Return to Player) – середній відсоток суми отриманих від гравців ставок, який повертається гравцеві при проведенні одного мільйона пусків на конкретному ігровому автоматі.

2.19. Реєстрація – самоідентифікація гравця на вебсайті Клубу з наступним автоматичним створенням його акаунту, а також відкриттям ігрового рахунку (після верифікації та першого поповнення).

2.20. Реєстр осіб, яким обмежено доступ до гральних закладів та / або участь в азартних іграх, – закрита для загального доступу база даних, що містить інформацію про фізичних осіб, для яких відповідно до поданих заяв чи за рішенням суду обмежено відвідування гральних закладів і участь в азартних іграх.

2.21. Ставка – грошові кошти або ігровий замінник гривні, що передаються гравцем організатору азартної гри, є умовою участі в азартній грі та сумою, виходячи з розміру якої, відповідно до правил такої азартної гри, визначається розмір виграшу.

3. ОСНОВНІ ПРИНЦИПИ ДІЯЛЬНОСТІ КЛУБУ

3.1. Основними принципами діяльності Клубу є:

захист прав, законних інтересів, життя та здоров'я гравців;
дотримання встановлених правил і однакових для всіх гравців умов азартної гри;
дотримання принципів відповідальної гри, встановлених уповноваженим органом;
дотримання принципів відповідальної гри, встановлених уповноваженим органом;
забезпечення дотримання принципів прозорості, стабільності, відкритості, рівності, справедливості й об'єктивності при проведенні азартних ігор;

сприяння розвитку місцевої економіки України, соціальної та культурної сфери, підтримка і розвиток спорту, медицини, освіти й науки в Україні шляхом податкових відрахувань до бюджету держави від проведення азартних ігор в Клубі й щорічних платежів за ліцензію.

4. ОБОВ'ЯЗКИ КЛУБУ

4.1. До сфери обов’язків Клубу входить:

вжиття заходів для недопущення до участі в азартних іграх осіб, які не досягли 21-річного віку, та осіб, щодо яких існує обмеження відповідно до Закону;
вжиття заходів для боротьби з ігровою залежністю (лудоманією), в тому числі шляхом розміщення на вебсайті інформаційних матеріалів щодо ігрової залежності та відповідальної гри, зокрема про обмеження віку гравця, шанс на виграш, принципи відповідальної гри, ознаки патологічної й проблемної ігрової залежності та про місця, де можна отримати допомогу в разі гральної залежності, а також розміщенням годинника, що відображає реальний час, на кожній сторінці вебсайту, за винятком самих азартних ігор, які фізично розміщуються на стороні розробника ігор;
розгляд скарг гравців і інших осіб, в тому числі в електронній формі, надання відповідей на них в терміни, визначені цими Умовами та правилами проведення азартних ігор;
виключення можливості прийняття від гравців ставок в кредит (з розстрочкою платежу) або з наступною оплатою, окрім оплати ставки кредитними або дебетовими картками при наявності авторизації платежу. Заборона на надання гравцеві позики для участі в грі;
невчинення дій, які можуть мати вплив на результати азартних ігор, унеможливлення зовнішнього впливу на такі результати;
проведення на вебсайті виключно дозволених Законом видів азартних ігор, в межах отриманої ліцензії;
використання при організації та проведенні азартних ігор онлайн-системи, яка виключає можливість несанкціонованого втручання в її роботу або створення умов для заздалегідь визначеного результату гри;
фіксування в онлайн-системі Клубу, пов'язаної каналами зв'язку (в режимі реального часу) з Державною системою онлайн-моніторингу (після її запуску), кожної операції щодо прийняття ставки, по кожній виплаті виграшу, а також інші операції, визначені порядком функціонування Державної системи онлайн-моніторингу;
своєчасне здійснення в повному обсязі виплат виграшів у грошовій безготівковій формі, згідно із заявками гравців, відповідно до правил проведення азартних ігор та протягом строку, встановленого цими Умовами та Законом, крім випадків, визначених Законом України «Про запобігання та протидію легалізації (відмиванню) доходів, отриманих злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення»;
вжиття заходів для недопущення виплати виграшів будь-яким третім особам, в тому числі особам, на користь яких гравець пропонує здійснити виплату або повернення (крім випадків звернення щодо повернення внесків, зроблених неповнолітнім, недієздатною особою або особою, цивільна дієздатність якої обмежена, або особою, внесеною до Реєстру осіб, яким обмежено доступ до гральних закладів та / або участь в азартних іграх, якщо особа, яка звертається за поверненням ставки, є законним представником такої особи);
ведення обліку виграшів (призів), величина яких постійно зростає і залежить від кількості внесених ставок (кумулятивного або прогресивного джек-поту) (за наявності таких виграшів);
оформлення цільового банківського депозиту або банківської гарантії здійснення виплати виграшів на суму 7200 розмірів мінімальної заробітної плати, встановленої на 1 січня поточного року.

5. ВИМОГИ ДО ГРАВЦЯ

5.1. Гравцем може бути виключно фізична особа, якій на дату участі у грі виповнився 21 рік. Законом забороняється приймати ставки й виплачувати виграші в азартній грі особам віком до 21 року.

5.2. Гравцями також не можуть бути наступні особи:

недієздатні й обмежено дієздатні;
які мають, згідно з законодавством, відповідні обмеження;
визнані Клубом небажаними;
внесення до Реєстру осіб, яким обмежений доступ до гральних закладів та / або обмежено участь в азартних іграх.

5.3. Гравець зобов'язаний:

дотримуватися вимог, передбачених Законом, цими Умовами та правилами проведення азартної гри;
надати на вимогу співробітника Клубу документ, що засвідчує особу і містить відомості про вік;
надати на вимогу співробітника Клубу правдиву інформацію для встановлення правочинності його участі в азартних іграх.

5.4. Забороняється брати участь в азартній грі:

засновникам (учасникам, акціонерам), керівникам Клубу;
представникам засновників (учасників, акціонерів), керівників Клубу;
особам, які можуть мати інформацію про результат азартної гри;
особам, які мають можливість вплинути на результат азартної гри або розмір виплати виграшу;
голові, членам та посадовим особам Комісії з регулювання азартних ігор і лотерей, крім проведення перевірок методом контрольних закупівель;
особам, які визнані Клубом небажаними;
особам, які проживають на тимчасово окупованих територіях України.

5.5. До участі в азартній грі на вебсайті не допускаються такі особи:

1) які на вимогу співробітника Клубу, якщо у нього виникли сумніви щодо досягнення особою 21-річного віку, не надали для ознайомлення документ, що посвідчує особу і містить відомості про вік особи;
2) які надали на вимогу представника Клубу неправдиві відомості про себе (прізвище, ім'я, по батькові, відомості про вік, адресу реєстрації місця проживання або місцезнаходження);
3) інші особи, визначені Законом;
4) обмежено дієздатні й недієздатні особи;
5) особи, внесені до Реєстру осіб, яким обмежено доступ до гральних закладів та / або участь в азартних іграх.

5.6. Вчинення фізичною особою ставки в азартну гру є укладенням між ним і Клубом договору про участь в азартній грі. Договір про участь в азартній грі вважається укладеним з моменту прийняття Клубом від фізичної особи ставки в азартну гру.

5.7. Якщо особа, попри встановлену Законом та цими Умовами заборону, взяла участь в азартній грі, договір про участь в азартній грі, за замовчуванням укладений між Клубом і такою особою, є нікчемним. Виплата виграшів за нікчемними договорами не здійснюється.

5.8. У разі якщо Клубом здійснено виплату виграшу цій особі, така виплата виграшу підлягає поверненню Клубу в повному обсязі в терміни, повідомлені такій особі Клубом.

5.9. Гравець має право обмежити свою участь в азартних іграх в Клубі шляхом встановлення особистих обмежень щодо ліміту коштів, які він бажає витратити на азартну гру.

5.10. Клуб має право збільшити мінімальний вік гравця для участі в азартній грі.

5.11. Гравець зобов'язаний в будь-який момент часу надати Клубу документи, що підтверджують його вік і особистість. Клуб має право закрити акаунт, призупинити дію ігрового рахунку і заблокувати участь в азартній грі, якщо користувачем не представлені такі документи.

5.12. У деяких юрисдикціях участь в азартних іграх на вебсайті Клубу може вважатися незаконною. Клуб не надає консультацій з цього приводу і не гарантує, що вчинення ставок для участі в азартних іграх на вебсайті повністю відповідає законодавству держави користувача. Реєструючись на вебсайті Клубу і роблячи ставку, користувач тим самим дає згоду на те, що приймає Умови, а також несе повну відповідальність за свої дії, навіть якщо участь в азартних іграх не є законною в державі його проживання або перебування.

5.13. Клуб не має наміру надавати послуги, які суперечать законодавству держави, в якій проживає або перебуває конкретний клієнт. Участь клієнта в азартних іграх на вебсайті є непрямим підтвердженням того, що це не суперечить законодавству країни його проживання або місцезнаходження. Клуб не несе відповідальності за незаконну участь в азартних іграх громадян іноземних держав.

5.14. Кожен гравець несе персональну відповідальність за сплату податків і зборів з виплат, отриманих ним у Клубі, згідно з податковим законодавством своєї держави. При цьому сума, яка залишається на його ігровому рахунку (балансі), не враховується у розрахунках податків і зборів, що підлягають до сплати.

5.15. Податки, які, відповідно до Податкового Кодексу України, сплачуються податковими агентами, утримуються під час виплат відповідно до Податкового Кодексу України та перераховуються до бюджету безпосередньо Клубом. У кожного гравця є доступ в Акаунті до повної історії отриманих ним виплат виграшів.

6. РЕЄСТРАЦІЯ, СТВОРЕННЯ АКАУНТА, ВІДКРИТТЯ РАХУНКУ

6.1. Участь в азартних іграх на вебсайті Клубу можлива тільки після реєстрації, з подальшим автоматичним створенням персонального Акаунта і відкриттям Ігрового рахунку в момент зарахування на нього першого внеску.

6.2. Можливі варіанти реєстрації з використанням:

Google-акаунту відвідувача,
email відвідувача,
номера мобільного телефону відвідувача.

6.3. Реєстрація з використанням email і номера телефону вимагає створення власного пароля для персоналізованого входу на вебсайт Клубу.

6.4. Під час реєстрації необхідно вказувати справжні дані, актуальний email і номер телефону.

6.5. Зареєстрованому гравцеві привласнюється індивідуальний ID, а також нік (ім'я на сайті), аналогічний зазначеному email або випадковий (при реєстрації за номером телефону).

6.6. Гравець може в будь-який момент змінити свій нік і пароль в акаунті в розділі «Налаштування».

6.7. Всі грошові кошти, що знаходяться на ігровому рахунку, а також грошові замінники, належать гравцеві на законних підставах, за винятком випадків, окремо обумовлених в Законі й в цих Умовах.

6.8. Реєструючись на вебсайті, фізична особа підтверджує, що вказує вірні відомості, які відповідають дійсності і є точними. У разі змін, персональної інформації, що відбулися, гравець зобов'язаний вносити ці зміни в реєстраційні дані Акаунту (розділ «Налаштування»). У разі невиконання цих вимог, виплату виграшів, нарахування бонусів та ін. може бути призупинено, а Акаунт гравця заблоковано.

6.9. Гравці несуть відповідальність за те, що вся інформація, яка надається ними Клубу при реєстрації, а також надалі (при поповненні депозиту і здійсненні ставок), є істинною. Ім'я, прізвище та по батькові (за наявності) в верифікованих документах строго відповідають імені, прізвищу та по батькові (за наявності) власника платіжних карток, розрахункових рахунків і платіжних гаманців, що використовуються для здійснення транзакцій.

6.10. Кожен гравець дає згоду на періодичні перевірки його персональної й контактної інформації Клубом, а також третіми особами, у яких є на це відповідні повноваження в рамках чинного законодавства.

6.11. Виплата грошових коштів з ігрового рахунку може обмежуватися під час проведення перевірки.

6.12. При виникненні питань або проблем під час реєстрації, відвідувачеві вебсайту слід звернутися в сервісну та технічну службу підтримки на email [email protected] , або за допомогою онлайн-чату, або телефоном, номер якого вказаний на сайті beton.ua.

6.13. Реєструючись на вебсайті й беручи участь в азартних іграх виключно з власної волі і бажанням, на свій страх і ризик, кожен гравець повною мірою усвідомлює і приймає існування ймовірності втрати ставки, вираженої в грошових коштах, і відсутність у нього будь-яких законних підстав пред'являти з цього приводу претензії Клубу.

7. БЕЗПЕКА АКАУНТА І ПАРОЛЬ

7.1. Розголошення пароля третім особам (навмисне або ненавмисне), надання їм доступу до email, Google акаунту або телефону, які використовувалися під час реєстрації, може стати причиною несанкціонованого проникнення в акаунт з наступною крадіжкою наявних на ігровому рахунку коштів.

7.2. Відповідальність за зберігання пароля і за всі дії, що здійснюються з використанням ігрового рахунку, покладається на гравця.

7.3. Компенсація Клубом збитку, понесеного гравцем в результаті злому його акаунта, що стався з вини гравця, не здійснюється.

7.4. У разі виявлення витоку інформації, яка стала чи може стати причиною несанкціонованого входу в акаунт гравця і / або доступу до його ігрового рахунку, він зобов'язаний негайно повідомити про це службу підтримки Клубу. Це стосується також будь-якого іншого порушення безпеки.

7.5. За запитом Клубу, користувач повинен якомога швидше надати докази несанкціонованого доступу. Клуб не несе відповідальність за шкоду, яка виникає в результаті порушення правил поводження з персональними даними, яке спричинило появу можливості доступу до рахунку гравця третіх осіб. При цьому для Клубу не має значення як саме було отримано доступ до акаунту: за сприянням гравця чи без його відома.

7.6. Якщо Ви забули пароль або втратили доступ до власних ресурсів, які використовувалися при реєстрації (email, телефон, Google акаунт), доступ гравця до власного акаунту на beton.ua відновлюється за допомогою посилання «Забули пароль?» в меню входу в акаунт або службою підтримки Клубу.

8. ВЕРИФІКАЦІЯ (ІДЕНТИФІКАЦІЯ, ВСТАНОВЛЕННЯ ДАНИХ) ГРАВЦЯ

8.1. До здійснення першої ставки з основного рахунку гравцеві необхідно підтвердити Google акаунт, email або номер телефону, які використовувалися ним при реєстрації, а також вказати свою дату народження, стать і пройти верифікацію документів, що засвідчують особу і вік.

8.2. Перед отриманням першої виплати з виграшів гравцеві потрібно підтвердити РНОКПП (реєстраційний номер облікової картки платника податків / ідентифікаційний код платника податків) шляхом завантаження селфі з карткою платника податків (довідкою про присвоєння РНОКПП).

8.3. Ідентифікація (верифікація, встановлення даних) гравця передбачає збір Клубом такої інформації:

прізвище, ім'я, по батькові (за наявності) особи;
вік (дата народження) особи;
наявність або відсутність особи в Реєстрі осіб, яким обмежений доступ до гральних закладів та / або участь в азартних іграх.

8.4. Стандартна верифікація в Клубі – це завантаження в акаунті гравця (розділ «Верифікація», підрозділ «Документи»):

копії паспорта, розгорнутого на першій сторінці (або іншого документа, що підтверджує особу та вік);
селфі з цим самим документом біля обличчя;
селфі з карткою платника податків, що засвідчує РНОКПП.

8.5. Клуб має право в будь-який момент запитати у гравця для ознайомлення додаткові документи, що підтверджують особу, зокрема, в режимі відеозв'язку. Це можуть бути:

додаткові сторінки паспорта або ID-картка;
платіжні банківські картки, з яких виконувалося поповнення ігрового рахунку;
інші документи.

8.6. Під час проведення ідентифікації (верифікації, встановлення даних) гравця за допомогою різних методів верифікації Клуб дотримується вимог законодавства про захист персональних даних.

8.7. Гравець несе відповідальність за достовірність наданих документів та інформації відповідно до законодавства.

8.8. Якщо гравець не надасть Клубу для ознайомлення необхідні документи, його Акаунт та ігровий рахунок може бути тимчасово заблоковано до надання запитуваних документів. Якщо такі документи не будуть надані без поважних причин у термін, встановлений Клубом, або якщо надана гравцем інформація є невірною, чи такою, що вводить в оману, не зовсім точною та ін., а також якщо така інформація не відповідає повною мірою дійсності, у цьому випадку гравцю забороняється брати участь в азартній грі, а договір про участь в азартній грі, укладений між Клубом та гравцем, є нікчемним згідно з Законом. Виплата (видача) виграшів (призів) за нікчемними договорами не здійснюється. Клуб залишає за собою право скасувати Акаунт гравця і закрити його ігровий рахунок. Вже виплачені суми виграшів підлягають поверненню Клубу в термін, який повідомлено особі Клубом.

9. ДУБЛЮЮЧИЙ РАХУНОК (МУЛЬТИАКАУНТ)

9.1. Кожен гравець має право створити на вебсайті beton.ua тільки один акаунт і відкрити один ігровий рахунок. У разі повторних реєстрацій з подальшим створенням додаткових акаунтів (мультиакаунтів) і відкриттям додаткових рахунків однією особою, кожен такий рахунок буде вважатися таким, що дублюється.

9.2. У разі, якщо гравець з яких-то причин бажає замінити наявний ігровий рахунок на новий, він повинен звернутися до служби підтримки Клубу для отримання дозволу на відкриття нового рахунку. При цьому старий рахунок буде заблоковано, всі залишки коштів на ньому будуть повернені гравцеві або переведені на його новий рахунок, а доступ до старого рахунку стане неможливим з моменту відкриття нового рахунку.

9.3. У разі повторної реєстрації з відкриттям дублювального рахунку без повідомлення Клубу і блокування вже наявного рахунку відбувається наступне:

9.3.1. Всі операції, виконані з використанням дублювального рахунку, вважаються недійсними.

9.3.2. Всі кошти, які були отримані з використанням дублювального рахунку, визнаються незаконними й підлягають поверненню Клубу. Йдеться про виграші, бонуси і т.ін. У разі, якщо ці кошти вже виплачені гравцеві з дублювального рахунку, вони підлягають поверненню в повному обсязі, в тому числі за рішенням суду, з подальшою оплатою винною стороною відповідних штрафів і судових витрат.

9.3.3. Клуб не повертає ані бонусні, ані реальні кошти, які знаходяться на дублювальному рахунку. Рішення про повернення втрачених Клубом коштів, які були виплачені з дублювального рахунку, приймається в односторонньому порядку. Це застосовується як у випадку, коли з такого рахунку були здійснені ставки й отримані виграші, так і в разі, коли не було здійснено жодної ставки, навіть якщо бонусні кошти просто перебували на рахунку.

9.3.4. Клуб не приймає запити на повернення заблокованих / загублених коштів з дублювального рахунку користувача. Не має значення з якою метою він створювався: для отримання бонусів, здійснення ставок, переведення в готівку незаконно отриманих коштів і т.ін. Відкриття нового дублювального рахунку з метою повернення заблокованих коштів з попереднього дублювального рахунку також вважається таким, що суперечить Умовам та заборонено.

Всі такі рахунки будуть виявлені й заблоковані. Клуб не несе відповідальність за збереження електронних замінників гривні, які знаходяться на таких рахунках. Початкові депозити не повертаються Гравцям, якщо буде встановлено, що дублювальний рахунок було відкрито з метою зловживань, в порушення цих Умов.

10. ДЕПОЗИТИ, ВНЕСЕННЯ КОШТІВ, ВИПЛАТИ

10.1. Виплати гравцям здійснюються в безготівковій формі через онлайн-систему Клубу, як організатора азартних ігор в мережі Інтернет, з урахуванням положень законів України «Про державне регулювання діяльності з організації та проведення азартних ігор» та «Про запобігання та протидію легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдженню зброї масового знищення» шляхом ініціювання відповідних платіжних операцій про безготівкові розрахунки.

10.2. Для участі в азартних іграх на ігровому рахунку гравця повинні бути розміщені грошові кошти та/або грошові замінники гривні.

10.3. Поповнення ігрового рахунку здійснюється з використанням платіжних банківських карт Visa / MasterCard за допомогою банківських систем дистанційного обслуговування та/або сервісів переказу коштів.

10.4. Мінімальна сума одноразового поповнення ігрового рахунку на вебсайті beton.ua дорівнює 100 грн.

10.5. Поповнюючи ігровий рахунок і використовуючи кошти для здійснення ставок на вебсайті, гравець підтверджує і приймає:

внесені ним кошти не є такими, що отримані з порушенням податкового, кримінального або іншого законодавства;
Клуб може відмовити гравцеві у відкликанні або поверненні внесених на його рахунок коштів або у скасуванні транзакцій, пов'язаних з процедурою поповнення ігрового рахунку.

10.6. На вебсайті beton.ua поповнення ігрового рахунку не може здійснюватися третіми особами: родичами, друзями, подружжям, партнерами по бізнесу тощо. Гравець вносить кошти на свій ігровий рахунок з використанням особистих платіжних карт Visa / MasterCard за допомогою банківських систем дистанційного обслуговування та/або сервісів переказу коштів. У разі виявлення Клубом факту поповнення ігрового рахунку з рахунків третіх осіб, всі виграші такого гравця можуть бути анульовані.

10.7. При запиті щодо повернення грошових коштів законному власникові ігрового рахунку всі витрати, пов’язані зі сплатою комісійних зборів та інших витрат можуть бути покладені на одержувача.

10.8. Готівкові кошти на сайті не приймаються. Клуб має право використовувати технічні можливості сторонніх організацій для обробки платежів (зокрема за допомогою банківських систем дистанційного обслуговування та/або сервісів переказу коштів), що здійснюються користувачем. Також за допомогою сторонніх систем можуть оброблятися виплати на користь гравця.

10.9. Гравець не має права відмовлятися від вже зроблених транзакцій. Їх не можна анулювати і скасовувати будь-яким можливим способом. У разі, якщо якимось чином це все ж буде зроблено, а раніше внесені кошти вже будуть використані для здійснення ставок на вебсайті, гравець повинен відшкодувати збитки, яких зазнав Клуб.

10.10. Клуб має право блокувати і анулювати будь-які операції, що здійснюються з ігрового рахунку, а також анулювати виграші в наступних випадках:

шахрайські або підозрілі поповнення рахунку,
використання чужих або вкрадених платіжних карт,
обмін між платіжними системами при поповненні рахунку.

Клуб має право інформувати відповідні організації та правоохоронні органи щодо будь-якого виду шахрайства. Також Клуб має право використовувати послуги колекторських агентств для повернення незаконно привласнених коштів. Клуб не несе відповідальність за будь-яке незаконне використання карт. При цьому не має значення, чи було зроблено заяву з боку користувача про їх втрату / крадіжку, чи ні.

10.11. Кошти з рахунку гравця можуть бути використані для компенсації збитку, що його зазнав Клуб. При шахрайстві і інших кримінальних діях, включаючи помилки гравця, будь-яка сума з його рахунку може бути списана на користь Клубу.

10.12. Ігровий рахунок не може розглядатися і використовуватися за аналогією з банківським. Отже, щодо нього не діє страхування, гарантії та інші інструменти, звичні для фінансових установ. Також на грошові кошти, розміщені на ігровому рахунку, не нараховуються відсотки, в тому числі пов'язані зі зміною курсу валют, криптовалют і т.ін.

10.13. У будь-який момент гравець має право подати заявку на виплату грошових коштів з Ігрового рахунку. При цьому повинні бути дотримані наступні умови:

всі засоби, що знаходяться на Ігровому рахунку гравця, перевірені на законність, відсутність скоєння з ними неприйнятних дій, в тому числі - жоден платіж раніше не був скасований або анульований;
всі необхідні процедури, пов'язані з верифікацією (в тому числі завантаження копії картки платника податків, що засвідчує РНОКПП), виконані в повному обсязі;
з моменту реєстрації в Клубі Гравцем внесена мінімальна сума депозиту.

10.14. Виплата без комісійних зборів гарантовано здійснюється тільки після виконання гравцем ставок на суму, що не менше внесених депозитів. В іншому випадку Клуб має право утримувати комісію в розмірі 5% від суми що виплачується.

10.15. Заявка на виплату коштів з ігрового рахунку формується в розділі КАСА → ВИПЛАТА із зазначенням бажаної суми (в рамках поточного балансу) в полі «До виводу». При цьому слід враховувати наступне.

10.15.1. Для отримання першої виплати необхідно підтвердити свій email та номер телефону, а також верифікувати картку платника податків, що засвідчує РНОКПП (окрім документа, що посвідчує особу та підтверджує досягнення 21-річного віку).

10.15.2. Виплати проводяться тільки на той банківський рахунок, з якого здійснювалося поповнення ігрового рахунку (депозиту).

10.15.3. Клуб може вимагати верифікації банківського рахунку, на який оформляється виплата.

10.15.4. Ліміт на мінімальну виплату складає 200 гривень. Заявки на виплати грошових коштів в сумі, менше встановленого ліміту, не приймаються.

10.15.5. При перерахуванні виплати (будь-якої) на банківський рахунок гравця усі активовані ним бонуси (черга бонусів у розділі БАЛАНС → Активний) анулюються.

10.15.6. Клуб залишає за собою право на проведення додаткових перевірок будь-яких транзакцій. Їх тривалість не може перевищувати двох діб.

10.15.7. При підозрі на порушення закону України «Про запобігання та протидію легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення», Клуб зобов'язаний провести додаткову перевірку з відстрочкою виплати не більше, як на 30 діб.

10.15.8. При наявності вагомих доказів, що мали місце шахрайські дії з боку гравця, Клуб має право відмовити йому у виплаті з подальшим блокуванням акаунту.

10.15.9. Для верифікації додаткових документів, крім необхідних в акаунті, використовується email [email protected] .

10.16. Клуб, як податковий агент, утримує з сум Виплат і перераховує до бюджету необхідні податки та збори за вас. Станом на дату затвердження цих Умов ставка податку з доходів фізичних осіб становила 18%, а ставка військового збору – 1,5%.

10.17. Виплата здійснюється в режимі 24/7 без перерви на вихідні та святкові дні.

10.18. Клуб докладатиме всіх залежних від нього зусиль для того, щоб максимальний термін виконання заявок на виплати становив 48 годин, однак на практиці, коли необхідні документи верифіковані, все відбувається значно швидше. Точні терміни виплат залежать від наступних факторів:

розмір суми, що підлягає сплаті,
дата та час виплати,
правила банку,
платіжна система, що використовується.

10.19. До тих пір, поки заявка на Виплату не виконана, гравець має право здійснювати ставки на заявлені до виплати кошти або повністю скасувати Виплату. Як тільки фінансовий менеджер підтвердить правомірність заявки, гроші в заявленому обсязі (за вирахуванням податків та зборів, що підлягають утриманню із заявленої суми, а також банківської комісії, у випадках, передбачених Умовами) будуть перераховані на банківський рахунок гравця. Клуб не несе відповідальність за затримку надходження виплат, пов'язану з відповідними правилами деяких банків.

10.20. Ліміти на зняття коштів користувачів:

добовий – не більше 30 000 гривень;
тижневий – до 150 000 гривень;
місячний – до 750 000 гривень.

11. ЗДІЙСНЕННЯ СТАВОК В АЗАРТНИХ ІГРАХ

11.1. Перш ніж здійснювати ставку в грі, необхідно переконатися, що баланс ігрового рахунку поповнений. За кожну транзакцію Гравець несе особисту відповідальність.

11.2. При натисненні на кнопку КАСА на вебсайті гравець потрапляє в розділ, в якому відбуваються поповнення ігрового рахунку, Виплата грошових коштів, ознайомлення з історією фінансових операцій тощо.

11.3. Клуб має право відмовити гравцеві у здійсненні транзакції внаслідок порушення ним одного з пунктів цих Умов. Операція щодо поповнення ігрового рахунку вважається завершеною тільки після того, як відповідна сума з'явиться на балансі гравця. Якщо гравець впевнений, що все зроблено правильно, але на балансі сума поповнення не з'явилася, йому необхідно звернутися до служби підтримки.

11.4. Після вибору розміру ставки й натиснення на кнопку СПІН (або ПУСК, СТАРТ і т. ін.) ставка вважається здійсненою.

11.5. У режимі «Авто» здійснюється послідовність ставок обраного розміру в автоматичному режимі, тобто без участі гравця. При цьому гра може бути зупинена в будь-який момент.

11.6. У разі збою ігрового автомата (наприклад, на барабанах не сформувалася комбінація символів) ставка може бути повернута на баланс гравця безпосередньо ігровим автоматом.

11.7. Оскільки гра відбувається на стороні провайдера ігор, Клуб не може скасувати або повернути гравцеві виконану ставку.

11.8. Інформація щодо відсотка виграшу (теоретичне повернення гравцеві) представлена в описі кожного конкретного ігрового автомата і знаходиться в діапазоні від 92% до 98% при здійсненні одного мільйона запусків.

12. РАХУНКИ, БОНУСИ, ВІДІГРАШ

12.1. Після реєстрації на вебсайті користувач отримує доступ до двох різних рахунків (субрахунків) – основного та бонусного, які об'єднані в один загальний ігровий рахунок.

12.1.1. На основний рахунок (депозит) надходять кошти, внесені користувачем, виграші і відіграні бонуси. З цього ж рахунку відбуваються списання при здійсненні ставок і отриманні виплат. Таким чином, на цьому рахунку знаходяться грошові кошти та/або ігрові замінники гривні, на які в будь-який момент можна пограти або поставити їх на виплату.

12.1.2. На бонусний рахунок надходять бонуси, винагороди тощо, а також виграші, які були отримані з використанням бонусів (наприклад, фріспінів, можливо, з використанням промокодів і т.ін.). Після відіграшу коштів на бонусному рахунку, вони переходять на основний рахунок. Відіграш коштів на бонусному рахунку, з подальшим їх переходом на основний, можливий тільки після того, як на балансі основного рахунку не залишається коштів.

12.2. Основний рахунок.

12.2.1. Доступний тільки якщо коштів та/або ігрових замінників гривні на його балансі досить для здійснення ставок.

12.2.2. У настільних іграх (таких як рулетка) і в грі з LIVE дилером ставки приймаються тільки з основного рахунку, а в слотах (крім тих, в яких відсутні барабани, таких як, наприклад, від Igrosoft і Big Time Gaming) – з будь-якого з субрахунків.

12.2.3. Після отримання виплати (будь-якої) з основного рахунку активний бонус на бонусному рахунку, а також всі активовані бонуси (Наступні бонуси) анулюються.

12.3. Бонусний рахунок. Відіграш.

12.3.1. Бонусний рахунок недоступний для здійснення ставок, поки на основному рахунку залишаються кошти та/або грошові замінники гривні (але можливо зарахування на нього коштів одного бонусу – активного). Дозволяється робити ставки з бонусного рахунку після використання коштів на основному рахунку робити ставки з бонусного рахунку з застосуванням правила відіграшу бонусів із заданим вейджером.

12.3.2. Вейджер – це коефіцієнт, множник, на який потрібно помножити суму бонусу, щоб обчислити суму його відіграшу. На суму відіграшу необхідно зробити ставок з бонусного рахунку, для перерахування бонусних коштів (які можуть збільшитися або зменшитися в процесі відіграшу) на основний рахунок. Поточна сума, що підлягає відіграшу, вказана в БАЛАНСІ, розділ АКТИВНИЙ БОНУС.

12.3.3. Виплата безпосередньо з бонусного рахунку не проводиться.

12.3.4. Після повного відіграшу активного бонусу всі кошти з бонусного рахунку переходять на основний рахунок з можливістю здійснення з них ставок або отримання як виплати.

12.3.5. Якщо в процесі відіграшу на бонусному рахунку залишається сума менш як 1 гривня, відіграш активного бонусу вважається завершеним.

12.3.6. Відіграш неможливий в настільних іграх і в грі з LIVE дилером, а можливий тільки в ігрових автоматах (слотах), крім тих, в яких відсутні барабани (таких як від Igrosoft і Big Time Gaming).

12.3.7. Термін, протягом якого повинен бути відіграний бонус, вказується в умовах акції. По завершенню терміну дії акції бонус анулюється.

12.3.8. Якщо гравець не здійснював авторизований вхід на вебсайт протягом 30 діб, всі його бонуси анулюються.

12.4. Стан бонусу.

12.4.1. Бонус Нараховано. Присутній в розділі БОНУСИ. Там же описані умови його отримання. Кнопка «Застосувати» є стартом для виконання цих умов (наприклад, внесення депозиту в КАСУ). Якщо це бездепозитний бонус, то після виконання необхідних умов кнопка «Застосувати» відразу переводить бонус в чергу активованих.

12.4.2. Бонус Активований. Всі умови отримання бонусу виконані в строк. Він присутній на БАЛАНСІ (в правому верхньому куті вебсайту або мобільного додатку), пункт АКТИВНІ в розділі НАСТУПНІ БОНУСИ.

12.4.3. Бонус Активний. Перший активований бонус, самий верхній в черзі, – АКТИВНИЙ БОНУС. Він зараховується на бонусний рахунок і очікує відіграшу (якщо це грошові кошти) або очікує на використання в грі (якщо це фріспіни), але тільки після того, як будуть зіграні всі кошти на основному рахунку. Відіграш інших бонусів в черзі активованих можливий тільки після відіграшу активного бонусу або в разі його скасування / деактивації.

12.4.4. Бонус Скасовано. Натиснувши в будь-який час кнопку «Скасувати» біля відповідного бонусу в черзі активованих, ви видаляєте його, а його місце займає бонус, що стоїть під ним.

12.4.5. Бонус Деактивовано. Це бонус, автоматично видалений з черги активованих, у зв’язку з тим що час, відпущений на його використання або відіграш за умовами акції, минув.

12.5. Бонусні умови.

12.5.1. Під депозит. Нараховується за умови внесення депозиту в сумі, більшій або рівній тій, що зазначена в умовах акції.

12.5.2. Бездепозитний. Нараховується за умови вчинення певної дії (наприклад, за верифікацію документів) або як подарунок, привітання, заохочення, нагорода тощо.

12.6. Тип бонусу.

12.6.1. Фіксована сума. Зараховується на бонусний рахунок і переходить на основний після відіграшу з обумовленим вейджером.

12.6.2. Відсоток від депозиту. Залежить від внесеного депозиту. В умовах акції задається мінімальна необхідна сума депозиту, а також максимальна можлива сума, яка може бути нарахована незалежно від величини депозиту.

12.6.3. Фріспіни (freespins, FS). Бонус у вигляді певної кількості обертань барабанів в конкретному слоті з конкретною ставкою. За умовами акції кількість фріспінів або ставка, з якою вони запускаються, може залежати від суми необхідного депозиту або від інших умов. Після запуску всіх бонусних фріспінів на бонусний рахунок надходить виграна сума, до якої далі застосовується правило відіграшу з заданим в акції вейджером.

12.6.4. Комбінований бонус. Гравцеві нараховується фіксована сума або відсотки від депозиту, одночасно з фріспінами. При цьому грошові кошти потрапляють на бонусний рахунок відразу, а потім додається сума, виграна в результаті відкрутки фріспінів. Далі відіграш із заданим вейджером застосовується до загальної суми.

12.7. Обмежень на кількість бонусів, що нараховуються користувачеві, немає.

13. ЗМОВА, ОБМАН, ШАХРАЙСТВО, КРИМІНАЛЬНА ДІЯЛЬНІСТЬ

13.1. Нижче наведені дії заборонені, оскільки вважаються істотним порушенням цих Умов:

надання будь-якої контактної, ідентифікаційної та фінансової інформації, що міститься в акаунті гравця, стороннім особам;
шахрайство в будь-якому вигляді, як-то: використання шкідливих додатків і / або програм, використання ботів та ін., вчинення дій, які дозволяють отримати дані платіжних інструментів, злом ігрових рахунків інших гравців, використання помилок програмного забезпечення вебсайту для отримання незаконного прибутку тощо;
відмивання незаконно отриманих грошових коштів, а також участь в іншій протизаконній діяльності, яка тягне за собою кримінально-правові наслідки;
змова або спроба змови (навмисна чи неусвідомлена) з іншими особами з метою здійснення незаконних операцій і дій, які тягнуть за собою незаконне збагачення коштом Клубу або інших гравців.

13.2. У разі виникнення обґрунтованої підозри, що видані бонуси, винагороди або заохочення отримані незаконно або використовуються для зловживань, Клуб має право в будь-який момент призупинити або зовсім скасувати заплановані виплати за виграші, які з ними пов'язані.

13.3. Клуб вживає всіх необхідних заходів для виявлення та припинення змови, а також виявлення осіб, які беруть в ній участь. У разі, якщо гравець, який був помічений в шахрайських діях, зазнав збитків, Клуб знімає з себе будь-яку відповідальність за те, що сталося, і направляє свої дії на захист від шахрайства себе та інших гравців з використанням всіх законних методів.

13.4. Гравець, який помітить, що хтось вчиняє або збирається вчинити незаконні (шахрайські) дії на вебсайті, повинен негайно повідомити про це Клуб по email [email protected], в онлайн-чаті, в месенджерах або телефоном.

13.5. У разі виникнення підозри в скоєнні або в намірі вчинити шахрайство, Клуб може в будь-який момент часу заблокувати ігровий рахунок порушника і заборонити йому вхід до акаунту. В цьому випадку кошти заблокованого клієнта не будуть повернені, а будуть спрямовані на компенсацію збитку, понесеного Клубом або іншими гравцями. Крім того, Клуб має право повідомити про незаконні дії представників правоохоронних органів. У разі, якщо користувач впевнений, що шахрайство сталося не з його вини, він зобов'язаний повною мірою сприяти розслідуванню інциденту.

У разі, якщо подібне буде виявлено, Клуб має право заблокувати рахунок гравця й утримати кошти, які на ньому знаходяться, як компенсацію за завдану шкоду.

14. ІНШІ ДІЇ, ЗАБОРОНЕНІ НА ВЕБСАЙТІ

14.1. На вебсайті заборонене агресивне й образливе спілкування, використання ненормативної лексики, загрози й спроби приниження гідності або загрози насильницьких дій стосовно інших гравців або до співробітників Клубу.

14.2. Завантаження інформації на вебсайт в обсязі, який може стати причиною збою роботи ресурсу, заборонене. Крім цього, не можна здійснювати будь-які дії, які можуть спричинити виникнення збоїв у функціонуванні сайту. В тому числі заборонене використання шкідливих програм, вірусів, троянів та ін. Масове розсилання, а також спам теж заборонено. Заборонено спотворювати або видаляти розміщену на сайті інформацію.

14.3. Користувачі зобов'язані використовувати послуги вебсайту тільки для участі в азартних іграх, розваг та спілкування. Копіювання матеріалів, частин вебсайту або цілком всього ресурсу заборонене без отримання на те відповідного письмового дозволу Клубу.

14.4. Користувачі не мають права зламувати вебсайт або здійснювати спроби це зробити. Не можна обходити систему безпеки вебсайту та ін. Доступ до послуг сайту буде заблокований, якщо Клуб виявить спробу злому вебсайту або інші дії, які служать для обходу системи безпеки чи отримання доступу до програмного забезпечення або рахунків інших користувачів. Також, правоохоронні органи будуть проінформовані про незаконні дії користувача.

14.5. При виникненні несправностей на вебсайті, які відбудуться через віруси, хакерські та / або DDoS-атаки, Клуб докладе всіх зусиль для усунення проблем. При цьому відповідальність за дії третіх осіб Клуб не несе. Також це стосується розміщення на вебсайті сторонніми користувачами незаконних матеріалів і посилань.

14.6. Рахунки гравців заборонено продавати або передавати третім особам.

14.7. Будь-які ставки гравців можуть бути перевірені. Аудит здійснюється силами Клубу. У разі виявлення шахрайських дій, що охоплюють отримання переваги гравцями, які використовували помилки або вразливості сайту, їхні рахунки будуть заблоковані.

Блокування проводиться тимчасово, а по закінченню розгляду – назавжди, якщо буде з'ясовано, що дії були навмисними, зі злим умислом. Рішення щодо повернення чи неповернення коштів заблокованого клієнта приймається відповідно до обставин.VI

15. СТРОК ДІЇ, АНУЛЮВАННЯ ДОГОВОРУ

15.1. Гравець несе відповідальність за всі дії, що здійснюються з його рахунком доти, поки ним не отримано підтвердження від Клубу, що рахунок закритий. Це стосується й періоду між відправленням запиту на закриття рахунку і діями Клубу щодо реалізації виконання запиту.

15.2. Клуб має право стягувати комісійний збір і суму боргу до того моменту, поки рахунок гравця не закритий. У разі блокування або видалення рахунку, кошти, які на ньому зберігалися, поверненню не підлягають. В тому числі це стосується бонусів та інших винагород. Після закриття рахунку доступ до нього стає неможливий.

15.3. Після анулювання рахунку гравця жодна зі сторін не має і не може мати зобов'язань по відношенню один до одного.

15.4. Видалення і / або блокування рахунку здійснюється Клубом без повідомлення гравця в наступних випадках:

припинення діяльності Клубу з організації азартних ігор;
якщо рахунок пов'язаний з раніше видаленим рахунком;
якщо рахунок пов'язаний із заблокованим раніше рахунком, при цьому залишок коштів повертається за запитом, за винятком випадків, передбачених у цих Умовах;
при спробах злому сайту або участі в змові;
при втручанні до програмного забезпечення або спробах маніпуляції з ним;
при незаконному використанні рахунку, наприклад, при спробах участь в азартних іграх на вебсайт в юрисдикціях, де це заборонено;
при публікації образливої й принизливої інформації на вебсайт.

15.5. У разі відсутності будь-яких рухів на рахунку протягом 6 і більше місяців Клуб має право закрити його без повідомлення. У цьому випадку дані Умови втрачають силу з дати закриття рахунку.

15.6. Клуб має право закрити рахунок і повідомити про це в листі, відправленому на email, який був зазначений користувачем при реєстрації. Залишок коштів, який зберігається на рахунку, буде повернено, за винятком випадків, зазначених в цих Умовах, які стосуються шахрайських дій, незаконної змови і т.ін. У разі неможливості перерахувати кошти їх законному власнику, вони будуть переведені на рахунок наглядового органу.

16. СИСТЕМНІ ПОМИЛКИ

Клуб намагається виправити будь-які помилки або збої, які виникають на вебсайті, максимально швидко. Клуб не несе відповідальності за несправне обладнання і засоби інформаційних технологій, які використовуються користувачем для доступу до вебсайту та участі в азартних іграх. Також, Клуб не несе відповідальність за роботу провайдерів Інтернету, що надають доступ до мережі.

17. ПОМИЛКИ І / АБО НЕДОЛІКИ

17.1. Згідно з правилами розробників ігрових автоматів в разі виникнення збоїв і несправностей всі результати й виграші поточного ігрового сеансу скасовуються.

17.2. В процесі перебування на вебсайті можливе виникнення обставин, при яких ставка була зроблена помилково. Наприклад, вказані невірні умови ставок, що не були відкориговані, або стався збій програмного забезпечення. Помилка може бути в підрахунках належного користувачеві виграшу та ін. В цих випадках гроші, виплачені гравцям, повинні бути повернені Клубу.

17.3. Клуб, провайдер гри має право скасовувати і / або обмежувати будь-які зроблені ставки.

17.4. При використанні коштів, що надійшли на рахунок гравця помилково або з порушенням цих Умов чи законодавства, Клуб має право скасувати ставки і / або виграші, отримані гравцем. У разі, якщо виграші вже були виплачені помилково, вважається, що сума передана гравцеві в довірче управління. Гравець зобов'язаний повернути всі грошові кошти, які він отримав помилково, в терміни, встановлені Клубом.

17.5. У разі виникнення помилки програмного забезпечення з боку гравця або на вебсайті, Клуб, в тому числі його співробітники і партнери не несуть відповідальність за можливі збитки, які будуть понесені гравцем.

17.6. У разі, якщо інформація, передана через Інтернет, перехоплена зловмисниками або третіми особами, Клуб, а також його філії та співробітники відповідальність за можливі збитки користувачів не несуть. Вся відповідальність за подібне лягає на гравця, який не використав повною мірою рекомендовані засоби для захисту трафіку Інтернету і допустив подібне.

18. ОБМЕЖЕННЯ ВІДПОВІДАЛЬНОСТІ КЛУБУ

18.1. Кожен користувач, реєструючись в Клубі, автоматично погоджується з тим, що, беручи участь в азартних іграх на вебсайті, він робить усвідомлений вибір, визнає і приймає всі можливі ризики, пов'язані з такими іграми, і повністю відповідає за свої дії й вибір.

18.2. Робота вебсайту здійснюється відповідно до Закону та цих Умов. Клуб не зобов'язаний давати або пропонувати будь-які додаткові гарантії й запевнення. Будь-яка діяльність Клубу в частині, яка стосується не зазначених в Правилах положень, виключається. Всі претензії до Клубу приймаються в письмовому вигляді на email [email protected] .

18.3. Клуб не несе ніякої відповідальності за правопорушення, завдану шкоду, недбалість, збитки, втрату персональних даних, репутації, престижу і т.ін., які можуть статися. Це стосується і будь-яких інших втрат, які не перераховані, і які наразі не можуть бути передбачені.

Також, Клуб не несе відповідальність за вміст будь-якого ресурсу, доступ до якого можна отримати через вебсайт. Претензії до Клубу в разі виникнення вищеперелічених ситуацій не приймаються.

19. ПОРУШЕННЯ УМОВ

19.1. У разі порушення гравцем даних Умов, він зобов'язується повністю компенсувати можливі збитки, які можуть охоплювати видатки та витрати (в тому числі й судові), позови, інші витрати і т.ін.

19.2. Користувач згоден із відшкодуванням збитків, а також зі здійсненням захисту інтересів Клубу, партнерів та всіх співробітників від домагань, відповідальності, видатків, збитків, судових витрат і будь-яких інших витрат, які виникають через наступні причини й внаслідок:

порушення гравцем даних Умов;
порушення гравцем законодавства, а також прав третіх осіб;
надання гравцем доступу до свого акаунту на вебсайті третім особам через свої персональні дані, при цьому не має значення добровільно було дано згоду на такі дії чи ні;
зарахування будь-яких виграшів, отриманих незаконним / шахрайським шляхом.

19.3. Якщо гравцем були порушені ці Умови, Клуб залишає за собою право (але не зобов'язаний) на наступні дії:

направити повідомлення з використанням контактних даних клієнта про те, що їм порушені Умови з вимогою припинити порушення;
здійснити тимчасове / постійне блокування рахунку, яке передбачає блокування участі гравця в азартних іграх на вебсайті;
відмовити в поверненні коштів, за винятком передбачених у даних Умовах випадків;
відкликати частину або всі кошти з рахунку гравця, якщо ним були здійснені серйозні порушення, згадані в цій Угоді.

19.4. У разі недотримання будь-якого з положень цих Умов, Клуб має право анулювати акаунт та ігровий рахунок користувача, а також розірвати укладений з ним договір щодо участі в азартних іграх.

20. ПРАВА НА РІЗНІ ОБ'ЄКТИ ІНТЕЛЕКТУАЛЬНОЇ ТА ІНШОЇ ВЛАСНОСТІ

20.1. Програмне забезпечення і весь контент, представлений на вебсайті, є об'єктом авторських прав і інших прав власності. Вони належать Клубу або використовуються на підставі договорів або ліцензій, виданих Клубу правовласниками. Будь-які матеріали друкованого і недрукованого характеру, які розміщені на вебсайті, можуть завантажуватися виключно на особистий персональний комп’ютер, ноутбук, смартфон або планшетний комп'ютер. При цьому їх видрук або інше використання дозволене тільки для особистого користування, що не має комерційного характеру.

20.2. Вільний доступ до матеріалів вебсайту не є підставою для надання користувачеві прав на інтелектуальну власність Клубу, яка охоплює авторське право, торгові марки, логотипи, контент, сценарії й види акцій, що проводяться в Клубі, маркетингові методики тощо.

20.3. Будь-яке використання, а також відтворення товарних знаків, логотипів й інших творчих матеріалів та контенту, представленого на сайті, заборонено, згідно з законодавством.

20.4. У разі вчинення будь-яких заборонених дій користувач несе повну відповідальність і зобов'язаний відшкодувати збитки й покрити витрати, які були понесені з його вини. Крім того, користувач зобов'язаний негайно повідомляти Клубу все, що йому відомо про вчинення будь-яких заборонених дій сторонніми особами.

Користувач зобов'язаний всіляко сприяти виправленню ситуації, допомагати в проведенні розслідувань і надавати іншу посильну допомогу, якщо зазначені вище дії були вчинені з використанням його акаунту.

21. ПЕРСОНАЛЬНА ІНФОРМАЦІЯ КОРИСТУВАЧА

21.1. Клуб суворо ставиться до збереження персональної інформації користувачів, ставлячи зобов'язання щодо зберігання і використання особистої інформації в пріоритеті перед іншими зобов'язаннями. Будь-яка особиста інформація, надана користувачами, обробляється відповідно до політики конфіденційності й при цьому використовуються всі необхідні заходи й засоби захисту.

21.2. Після того, як клієнт надає особисту інформацію, він автоматично погоджується з тим, що Клуб має право обробляти його персональні дані. Це необхідно для дотримання та виконання Закону, Умов, а також нормативних і законодавчих зобов'язань Клубу.

21.3. Клуб не розкриває особисту інформацію користувачів третім особам. Винятком є співробітники, яким необхідний доступ до особистих даних клієнтів для виконання своїх службових обов'язків.

21.4. Вся інформація, яка отримана від користувача, включаючи персональні дані, звернення, заяви й кореспонденція зберігається у вигляді електронних копій.

23.3. Користувач згоден з тим, що результати ігор на сайті визначаються виключно випадково, відповідно кінцевий результат необхідно сприймати в тому вигляді, в якому він був отриманий. В разі, якщо помічено розбіжність між досягненнями у грі, що опинилися на комп'ютері (мобільному пристрої) користувача і на сервері Клубу, слід визнавати, що останні є більш точними та не підлягають оскарженню. 25. ПЕРЕДАЧА ПРАВ ТА ОБОВ'ЯЗКІВ

25.1. Клуб має право передавати дані Умови іншим компаніям (частково або повністю). При цьому згода користувачів на таке не потрібна. Це буде вважатися справедливим в тих випадках, якщо клієнт зможе користуватися послугами вебсайту на тих самих, не менш вигідних для себе умовах.

26. ОБСТАВИНИ НЕПЕРЕБОРНОЇ СИЛИ

26.1. У разі виникнення обставин непереборної сили, Клуб не несе відповідальність за невиконання або затримку виконання Умов та зобов'язань щодо користувачів. 26.2. На час дії форс-мажорної ситуації діяльність вебсайту може вважатися зупиненою. На цей же період діє відстрочка на виконання зобов'язань Клубу перед користувачами. Клуб буде намагатися розв'язувати проблеми, що виникли через форс-мажор, максимально оперативно. Для цього будуть використані всі можливі технічні та людські ресурси.

27. ВІДМОВА ВІД ЗОБОВ'ЯЗАНЬ

27.2. Відмова Клубу від виконання своїх зобов'язань має юридичну силу тільки в тому випадку, якщо вона передана користувачеві в письмовій формі. При цьому відмова від зобов'язань можлива тільки в разі виникнення форс-мажору або виняткових випадків, про які згадується в цих Умовах.

28. ПОДІЛЬНІСТЬ УГОДИ

28.1. У разі втрати юридичної сили одним або декількома положеннями Умов, інші положення вважаються законними й не втрачають юридичну силу відповідно до чинного законодавства. Частина Умов, яка стала недійсною або неможливою для виконання, повинна бути змінена відповідно до права, що застосовується. При цьому зміни повинні відображати початкові цілі максимально близько і точно.

31. ЗМІНА УМОВ

31.1. Клуб має право вносити правки, редагувати, змінювати й оновлювати дані Умови відповідно до нових комерційних та юридичних умов, а також умов обслуговування користувачів сайту.

31.2. Будь-які зміни й доповнення, зокрема апдейти програмного забезпечення, стають доступними користувачам відразу після їх реалізації на сайті. Клуб інформує користувачів про зміни, що відбулися, зокрема, відображаючи їх в даних Умовах.

В разі наявності суперечностей між цими Умовами та правилами проведення промоакцій, під час проведення відповідних промоакцій, ці Умови застосовуються в частині, що не суперечить правилам проведення відповідних промоакцій.

1.1. These «Terms and Conditions» and any appendices, additions, and other integral parts to them (hereinafter referred to as the «Terms and Conditions») are the rules of the operator acting in strict accordance with, within and based on the legislation of Ukraine on gambling, namely:

The Tax Code of Ukraine,
The Law of Ukraine «On State Regulation of Activities on Organization and Conduct of Gambling» (hereinafter referred to as the «Law»),

Legal acts regulating relations in gambling and relevant international treaties of Ukraine, ratified by the Verkhovna Rada of Ukraine.

1.2. BETON online, under which CITYCODE LLC (hereinafter referred to as the «Club») operates is located at 3B Baidy-Vyshnevetsky str. Kyiv, 04123, Ukraine, with identification code 45358454, and carries out activities for the organization and conduct of casino gambling on the Internet, based on the relevant license issued on November 20, 2023, for five years by the Commission for Regulation of Gambling and Lotteries based on Decision No. 364 dated November 03, 2023.

1.3. The Club operates on the Internet through a website with the domain name beton.ua (hereinafter referred to as the Website), which belongs to it, meets the requirements of the Law, and exclusively through an online system, also meets the requirements of the Law.

1.4. By visiting or using any of the sections of the website, as well as registering on it with the intention of creating an account, and subsequently concluding an agreement with the Club on participation in gambling after placing the first bet on the terms set out in these Terms, you:

1.4.1. Confirm that you are at least 21 years old and there are no restrictions on your participation in gambling;

1.4.2. Agree with these Terms and Conditions, the Privacy Policy, the principles of Responsible Gaming, the Game Rules, and other documents posted on the website;

1.4.3. Confirm that you are the owner of the bank account (including card account) from which the game account with the Club will be replenished and to which the payments from the Club will be transferred, and confirm that you have the legal right to dispose of funds in this account;

1.4.4. Consent to the processing of your data and its provision, if necessary, to the relevant financial institutions to make payments;

2. DEFINITION OF TERMS

2.1. An account is a player's personal account available only to them and authorized employees of the Club. It contains the player's profile with financial information, settings, notifications, verification, bonuses, and other information.

2.2. Gambling is any game, the condition of participation in which is the player placing a bet that gives the right to receive a win (prize), the probability of receiving and the amount of which depends in whole or in part on chance, as well as on the player's knowledge and skill.

Any game that lacks at least one of the following features shall not be considered gambling:

betting;
the possibility of receiving or not receiving a win (prize);
the probability of winning (prize), and its amount depends entirely or partially on chance.

2.3. Casino gambling conducted on the Internet – cylindrical games (roulette), dice games, and games on slot machines.

2.4. Verification (identification, data establishment) – confirmation of the player's identity, age, and right to participate in gambling.

2.5. Winnings (prize) – the amount of funds to be paid (issued) to the Player by making a cashless transfer to their bank account in case of winning a game of chance following the rules of such game of chance posted on the website, which exceeds the total amount of funds deposited by the Player to the Game Account, reduced by the total amount of all amounts returned/paid to such Player.

2.6. Refund of funds deposited by the Player for participation in gambling – the amount of funds that, at the request of the Player, is returned to them by transferring to a bank account and does not exceed the total amount of funds deposited by the Player to the Game Account, reduced by the total amount of all refunded/paid amounts to such Player.

2.7. Payout means a transaction to transfer the amount of funds specified for withdrawal in the player's Account to the bank account at the player's request. Within the framework of one Payout, part of the amount may be a Refund of funds deposited by the Player to participate in gambling and part a winning.

2.8. The random number generator is an integral part (including remote) of the slot machines and the Club's online system. During gambling on the website, it creates a sequence of unrelated numbers and ensures the random nature of winnings (prize).

2.9. Jackpot – the maximum winning (prize) provided for by the rules of gambling, the value of which is set by the operator or determined by the total number of bets placed by players.

2.10. Slot machine or roulette game means a gambling game that is conducted using a slot machine or roulette directly on the server of the game developer, and in which the probability of winning (prize) and its value are determined by a random number generator.

2.11. Game hryvnia substitute represents a material means of gambling, an electronic money substitute that allows placing a bet in a game of chance and is presented on the balance of the launched game in an amount that is a multiple of the amount on the player's game account with a coefficient equal to the selected denomination. The game substitute for hryvnia is purchased in exchange for real money and, at the player's request, is subject to exchange for the corresponding equivalent.

2.12. Game account (deposit) – a player's client account. Balance – a part of the Club's online system that provides the player with full information about his financial actions (replenishment, payments, bets, winnings), as well as contains the information necessary to identify the player.

2.13. A player is an individual who:

at the time of participation in a gambling game has reached the age of 21
has legal capacity,
is not included in the Register of Individuals Restricted from Access to Gambling Facilities or Participation in Gambling
has voluntarily registered on the Club's website, passed verification, and participated in a game of chance.

2.14. Cashier – a section of the website where replenishment of the Game Account (deposit), sale (issuance) and exchange of Game Substitutes for UAH, acceptance of bets from Players, ordering a Refund of funds deposited by Players for participation in gambling, payment of Winnings based on the results of a gambling game, and other actions are carried out.

2.15. Mobile Application means a computer program (software) designed to work on mobile devices, which is used to carry out the Club's activities related to the organization and conduct gambling through the online system.

2.16. The Club's online system is a set of software and hardware tools that ensures the organization and conduct of gambling, collection of data on accepted bets, their accounting and registration, determination, accounting, and payment of winnings, as well as other operations related to the organization and conduct of gambling, storage of relevant information.

2.17. Responsible gambling is the basic principle of organizing and conducting gambling, and provides for the Club to take measures to prevent and minimize the negative consequences of an individual's participation in gambling, as well as measures aimed at organizing self-restrictions and self-control for players.

4. RESPONSIBILITIES OF THE CLUB

4.1 The Club's responsibilities include:

taking measures to prevent individuals under the age of 21 and persons subject to restrictions per the Law from participating in gambling;
taking measures to combat gambling addiction, including posting information on gambling addiction and responsible gambling on the website, in particular, on the player's age limit, the chance of winning, the principles of responsible gambling, signs of pathological and problem gambling addiction and places where you can get help in case of gambling addiction, as well as placing a clock showing real-time on each page of the website, except for gambling games themselves, which are physically placed on the side of the game developer;
reviewing complaints from players and other people, including in electronic form, responding to them within the time limits specified in these Terms and Conditions and the rules of gambling;
excluding the possibility of accepting bets from players on credit (with installment payments) or with subsequent payment, except for paying bets with credit or debit cards if payment is authorized. Prohibition on providing a player with a loan to participate in the game;
not performing actions that may affect the results of gambling, preventing external influence on such results;

5. REQUIREMENTS FOR THE PLAYER

5.1. A player can only be an individual who has reached the age of 21 on the date of participation in the game. The law prohibits accepting bets and paying out winnings in a gambling game to people under the age of 21.

5.2. The following individuals may not be players:

those who are legally incapacitated or have limited legal capacity;
those who have relevant restrictions according to the legislation;

5.4. It is prohibited to participate in gambling by:

people who can influence the outcome of a gambling game or the amount of winnings;
the chairman, members, and officials of the Commission for Regulation of Gambling and Lotteries, except for control purchases;
people recognized by the Club as undesirable;
people residing in the temporarily occupied territories of Ukraine.

5.5. The following people are not allowed to participate in gambling on the website:

1) Those who have not provided an identity document containing information about their age for review, if a Club employee has doubts.
2) Those who have provided false information about themselves (surname, name, patronymic, information about age, address of registration of residence or location) at the request of a representative of the Club;
3) Other individuals specified by the Law;
4) People with limited capacity and incapacitated persons;
5) People included in the Register of Persons Restricted from Access to Gambling Facilities and Participation in Gambling.

5.6. Placing a bet on a gambling game by an individual is the conclusion of a gambling participation agreement between them and the Club. The agreement of participation in a game of chance shall be deemed concluded from the moment the Club accepts a bet on a game of chance from an individual.

5.7. If a person, despite the prohibition established by the Law and these Terms and Conditions, participates in a gambling game, the agreement of participation in a gambling game concluded by default between the Club and such person shall be invalid. No winnings shall be paid out under invalid agreements.

5.8. In case the Club has paid out winnings to such a person, such payment of winnings shall be returned to the Club in full within the terms notified to such person by the Club.

5.9. The Player has the right to limit his participation in gambling at the Club by setting personal restrictions on the limit of funds they wish to spend on gambling.

5.10. The Club has the right to increase the minimum age of a player to participate in a gambling game.

5.11. The player is obliged to provide the Club with documents confirming their age and identity at any time. The Club has the right to close the account, suspend the game account, and block participation in the game of chance if the user does not provide such documents.

5.12. In some jurisdictions, participation in gambling on the Club's website may be considered illegal. The Club does not provide advice on this matter and does not guarantee that placing bets to participate in gambling on the website fully complies with the laws of the user's country. By registering on the Club's website and placing a bet, the user hereby agrees to accept the Terms and Conditions and is fully responsible for their actions, even if participation in gambling is not legal in the state of their residence or stay.

5.13. The Club does not intend to provide services that contradict the legislation of the state in which a particular client resides or is staying. The client's participation in gambling on the website is an indirect confirmation that this does not contradict the legislation of the country of his residence or location. The Club is not responsible for illegal participation in gambling by citizens of foreign countries.

5.14. Each player is personally responsible for paying taxes and fees on payments received by them from the Club according to the tax legislation of their country. 6.10. Each player agrees to periodic checks of their personal and contact information by the Club, as well as by third parties authorized to do so under the applicable law.

6.11. The payment of funds from the game account may be limited during the verification.

7. ACCOUNT SECURITY AND PASSWORD

7.1. Disclosure of the password to third parties (intentional or unintentional), providing them with access to the email, Google account, or phone number used during registration may result in unauthorized access to the account with subsequent theft of funds available on the game account.

7.2. The player is responsible for keeping the password and for all actions performed using the game account.

7.3. The Club shall not compensate the player for any losses incurred as a result of the hacking of their account that occurred through the player's fault.

7.4. In case of detection of information leakage that has become or may become the cause of unauthorized entry into the player's account or access to their game account, they are obliged to immediately notify the Club's support service. This also applies to any other security breach.

7.5. At the request of the Club, the user must provide evidence of unauthorized access as soon as possible. The Club shall not be liable for any damage arising from the violation of the rules of personal data handling, which resulted in the possibility of access to the player's account by third parties. At the same time, it does not matter to the Club how exactly the account was accessed (with the player's assistance or without his/her knowledge).

7.6. If you have forgotten your password or lost access to information that was used during registration (email, phone, Google account), the player's access to their account on beton.ua is restored using the link «Forgot your password?» in the account login menu, or by contacting the Club's support service.

8. VERIFICATION (DATA IDENTIFICATION) OF THE PLAYER

8.1. Before placing the first bet from the main account, the player must confirm the Google account, email or phone number used during registration, as well as indicate their date of birth, gender and pass the verification of identity and age documents.

8.2. Before receiving the first payout from the winnings, the player needs to confirm the TIN (taxpayer identification number) by uploading a selfie with a taxpayer card (certificate of TIN assignment).

8.3. Identification (data verification) of the player involves the collection of the following information by the Club:

surname, name, patronymic (if any) of the person;
age (date of birth) of the person;
presence or absence of a person in the Register of people who are restricted from accessing gambling facilities and participating in gambling.

8.4. Standard verification in the Club is the uploading of the following documents in the player's account (section «Verification», subsection «Documents»):

a copy of the passport with the first page unfolded (or other document confirming the identity and age);
a selfie with the same document near the face;
a selfie with a taxpayer's card certifying the TIN.

8.5. The Club has the right to request additional identity documents from the player at any time for review, in particular, via video communication. These may include:

additional pages of a passport or ID card;
payment bank cards that were used to deposit funds to the game account;
other documents.

8.6. When identifying (verifying data) a player using various verification methods, the Club complies with the requirements of the legislation on personal data protection.

8.7. The player is responsible for the accuracy of the provided documents and information in accordance with the law.

8.8. If a player fails to provide the Club with the necessary documents for review, their Account and game account may be temporarily blocked until the requested documents are provided. If such documents are not provided without good reason within the period set by the Club, or if the information provided by the player is incorrect, misleading, not entirely accurate, etc., as well as if such information does not fully correspond to the reality, the player is prohibited from participating in a gambling game and the agreement of participation in a gambling game concluded between the Club and the player is invalid in accordance with the Law.

No winnings (prizes) shall be paid out (withdrawn) under invalid agreements. The Club reserves the right to cancel the Player's Account and close their game account. The amounts of winnings already paid shall be returned to the Club within the period notified to the person by the Club.

9. DUPLICATE ACCOUNT (MULTI-ACCOUNT)

9.1. Each player has the right to create only one account on the beton.ua website and open one game account. In case of repeated registrations with the subsequent creation of additional accounts (multi-accounts) and opening of additional accounts by one person, each such account will be considered a duplicate.

9.2. In case a player wishes to replace an existing game account with a new one for any reason, they must contact the Club's support service to obtain permission to open a new account. In this case, the old account will be blocked, all balances on it will be returned to the player or transferred to his new account, and access to the old account will become impossible from the moment the new account is opened.

9.3. In case of re-registration and opening a duplicate account without notifying the Club and blocking the existing account, the following happens:

9.3.1. All transactions made using a duplicate account are considered invalid.

9.3.2. All funds received using a duplicate account are considered illegal and shall be returned to the Club. This includes winnings, bonuses, etc. In case these funds have already been paid to the player from the duplicate account, they are subject to return in full, including by court decision, with the subsequent payment of the relevant fines and court costs by the guilty party.

9.3.3. The Club does not return either bonus or real funds held on the duplicate account. The decision to refund the funds lost by the Club that were paid out from the duplicate account is made unilaterally. This applies both in the case when bets were placed and winnings were received from such an account, and in the case when no bets were placed, even if the bonus funds were simply held on the account.

9.3.4. The Club does not accept requests for the return of blocked/lost funds from a duplicate user account. It does not matter for what purpose it was created: to receive bonuses, place bets, cash out illegally obtained funds, etc. Opening a new duplicate account in order to return the blocked funds from the previous duplicate account is also considered to be contrary to the Terms and Conditions and is prohibited.

All such accounts will be detected and blocked. The Club is not responsible for the safety of electronic substitutes for hryvnia held on such accounts. Initial deposits will not be refunded to the Players if it is established that the duplicate account was opened for the purpose of abuse and violation of these Terms.

10. DEPOSITS, WITHDRAWALS, PAYMENTS

10.1. Payments to players are made in non-cash form through the online system of the Club as a gambling operator on the Internet, taking into account the provisions of the Laws of Ukraine «On State Regulation of Activities on Organization and Conduct of Gambling» and «On Prevention and Counteraction to Legalization (Laundering) of Proceeds of Crime, Terrorist Financing and Financing of the Proliferation of Weapons of Mass Destruction», by initiating the relevant payment transactions for non-cash payments.

10.2. In order to participate in gambling, the player's game account must contain funds or substitutes for hryvnia.

10.6. On the beton.ua website, the replenishment of the game account cannot be carried out by third parties: relatives, friends, spouses, business partners, etc. The player deposits funds to their game account using personal Visa/Mastercard payment cards via banking remote service systems or money transfer services. In case the Club detects the fact of replenishment of the game account from the accounts of third parties, all winnings of such a player may be canceled.

10.7. When requesting a refund to the legal owner of the game account, all costs associated with the payment of commissions and other expenses may be imposed on the recipient.

10.8. Cash is not accepted on the website. The Club has the right to use the technical capabilities of third-party organizations to process payments (in particular, through remote banking systems or money transfer services) made by the user. Payments in favor of the player may also be processed using third-party systems.

10.9. The player has no right to refuse transactions already made. They cannot be canceled or reversed in any way possible. In the event that this is somehow done and the previously deposited funds are already used to place bets on the website, the player must reimburse the losses incurred by the Club.

10.10. The Club has the right to block and cancel any transactions made from the game account, as well as to cancel winnings in the following cases:

fraudulent or suspicious deposits to the account,
use of other people's or stolen payment cards,
exchange between payment systems when making a deposit.

The Club has the right to inform the relevant organizations and law enforcement agencies about any type of fraud. The Club also has the right to use the services of collection agencies to recover misappropriated funds. The Club is not responsible for any illegal use of cards. It does not matter whether the user has made a statement about their loss/theft or not.

10.11. Funds from the player's account can be used to compensate for the damage incurred by the Club. In case of fraud and other criminal acts, including player's mistakes, any amount from the player's account may be debited in favor of the Club.

10.12. A game account cannot be considered and used by analogy with a bank account. Therefore, it is not subject to insurance, guarantees and other instruments usual for financial institutions. In addition, no interest is accrued on funds placed on a game account, including those related to changes in exchange rates, cryptocurrencies, etc.

10.13. At any time, the player has the right to apply for a withdrawal of funds from the Game Account. In this case, the following conditions must be met:

all funds on the player's Game Account have been checked for legality, the absence of unacceptable actions with them, including no payment has been previously canceled or voided;
all the necessary procedures related to verification (including uploading a copy of the taxpayer's card certifying the individual taxpayer identification number) have been completed in full;
the Player has made the minimum deposit amount from the moment of registration with the Club.

10.14. Payout without commission fees is guaranteed only after the player has placed bets at an amount not less than the deposited amount. Otherwise, the Club has the right to withhold a commission in the amount of 5% of the amount to be paid out.

10.15. An application for withdrawal of funds from the game account is formed in the CASHIER → WITHDRAWAL section, indicating the desired amount (within the current balance) in the «To Withdraw» field.

The following should be taken into account:

10.15.1. To receive the first payment, you must confirm your email and phone number, as well as verify your taxpayer card certifying the individual taxpayer identification number (in addition to an identity document confirming the age of 21).

10.15.2. Payments are made only to the bank account from which the game account (deposit) was replenished.

10.15.3. The Club may require verification of the bank account to which the payment is made.

10.15.4. The minimum payout limit is 200 UAH. Applications for payment of funds in an amount less than the established limit are not accepted.

10.15.5. When a payout (any) is transferred to a player's bank account, all bonuses activated by the player (bonus queue in the BALANCE → Active section) are canceled.

10.15.6. The Club reserves the right to conduct additional checks on any transactions. Their duration cannot exceed two days.

10.15.7. In case of suspicion of violation of the Law of Ukraine «On Prevention and Counteraction to Legalization (Laundering) of Proceeds of Crime, Terrorist Financing and Financing of the Proliferation of Weapons of Mass Destruction», the Club is obliged to conduct an additional check with a delay in payment for no more than 30 days.

10.15.8. If there is strong evidence of fraudulent actions on the part of the player, the Club has the right to refuse to pay him/her with further blocking of the account.

10.15.9. For verification of additional documents, in addition to those required in the account, the email [email protected] is used.

10.16. The Club, as a tax agent, withholds the necessary taxes and fees for you from the Payouts and transfers them to the budget. As of the date of approval of these Terms, the personal income tax rate was 18% and the military duty rate was 1.5%.

10.17. Payments are made 24/7 without interruption on weekends and holidays.

10.18. The Club will make every effort to ensure that the maximum processing time for payment requests is 48 hours, but in practice, when the necessary documents are verified, everything happens much faster.

The exact timing of payments depends on the following factors:

the amount of money to be paid,
date and time of payment,
bank regulations,
the payment system used.

10.19. As long as the request for a Payout is not fulfilled, the player has the right to place bets on the funds claimed for payment or cancel the Payout completely. As soon as the financial manager confirms the legitimacy of the request, the money in the requested amount (minus taxes and fees to be withheld from the requested amount, as well as bank fees, in cases provided for by the Terms and Conditions) will be transferred to the player's bank account. The Club is not responsible for delays in the receipt of payments due to the relevant rules of some banks.

10.20. Withdrawal limits for users:

daily – up to 30,000 UAH;
weekly – up to 150,000 UAH;
monthly – up to 750,000 UAH.

11. PLACING BETS IN GAMBLING

12.4.3. Bonus Active – The first activated bonus, the top one in the queue, is the ACTIVE BONUS.
